Hometown Events ("Hometown Events") respects intellectual property rights and expects users to respect the rights of others. This Copyright & Intellectual Property Policy explains how we address copyright and related IP concerns on HometownEvents.org (the "Platform").

1. Respect for Intellectual Property

Users may not upload, post, or distribute content that infringes copyrights, trademarks, trade dress, patents, publicity rights, privacy rights, or other proprietary rights of any person or entity.

2. User Responsibility

By submitting Content, you represent that you own or have obtained all necessary rights and permissions. This includes event photos, flyers, logos, vendor marks, and promotional materials displayed in listings or profiles.

3. Hometown Events Intellectual Property

The Platform's design, software, branding, and original materials are owned by Hometown Events or its licensors and may not be copied, modified, or exploited without permission, except as allowed by applicable law or these Terms.

4. Copyright Reporting Process

If you believe content on the Platform infringes your copyright, send a notice to our designated copyright agent at info@hometownevents.org with the subject line "Copyright Notice." Include:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the infringing material and sufficient information to locate it on the Platform (URL, listing title, screenshot).
  3. Your contact information, including name, address, telephone number, and email.
  4. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
  6. Your physical or electronic signature.

5. Other Intellectual Property Complaints

For trademark, publicity, or other intellectual property concerns that are not copyright claims under the DMCA, contact info@hometownevents.org with "IP Complaint" in the subject line and provide details of the rights asserted, the allegedly infringing content, and requested remedy.

6. Counter-Notice Procedures

If you believe content was removed in error, you may submit a counter-notification to info@hometownevents.org with the subject line "DMCA Counter-Notice" including:

  1. Identification of the removed material and its prior location.
  2. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  3. Your name, address, phone number, and consent to jurisdiction of the federal district court for your address (or New York if outside the U.S.).
  4. Your physical or electronic signature.

We may restore content consistent with the DMCA and applicable law after receiving a valid counter-notice and any required waiting period, unless the complainant initiates legal action.

7. Repeat Infringement Policy

In appropriate circumstances, Hometown Events will terminate accounts of users determined to be repeat infringers. We may also terminate accounts for a single egregious violation or bad-faith abuse of the reporting process.

8. Content Removal Procedures

Upon receiving a valid copyright notice or determining that content violates this policy, we may remove or disable access to the content, reject pending listings, suspend accounts, and notify the submitting user where appropriate.

We act in reasonable good faith but cannot guarantee immediate removal in all cases. Emergency requests involving impersonation, fraud, or safety may be prioritized.

9. Misrepresentation

Knowingly submitting false infringement claims or counter-notices may expose you to liability under applicable law, including damages and attorneys' fees under 17 U.S.C. § 512(f) where applicable.
