1. Definitions
For purposes of these Terms, the following definitions apply:
- "Account" means a registered user profile created through the Platform's registration process.
- "Content" means all text, images, photographs, graphics, logos, flyers, listings, descriptions, comments, metadata, and other materials submitted, posted, displayed, or transmitted through the Platform.
- "Listing" means an event, sale, market, fundraiser, vendor opportunity, or other community happening submitted to or displayed on the Platform.
- "Organizer" means a user who creates, manages, or promotes events or community happenings through the Platform, including users with an organizer account type or organizer profile.
- "Vendor" means a user who offers goods or services at events, markets, fairs, or related community happenings, including users with a vendor account type or vendor profile.
- "User," "you," or "your" means any individual or entity accessing or using the Platform.
- "User-Generated Content" or "UGC" means Content submitted by users rather than by Hometown Events.
- "Featured Listing" means a listing designated for enhanced visibility through administrative selection or future paid promotion services.
- "Paid Services" means any future fee-based offerings, including subscriptions, advertising packages, featured placements, or promotional tools.
- "Third-Party Services" means websites, applications, payment processors, email providers, analytics tools, or other services not owned or controlled by Hometown Events.
2. Eligibility Requirements
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to create an account or submit listings on the Platform. If you are under eighteen (18), you may only use the Platform with the involvement and consent of a parent or legal guardian who accepts these Terms on your behalf.
By using the Platform, you represent and warrant that: (a) you meet the eligibility requirements; (b) you have the legal capacity to enter into these Terms; (c) if acting on behalf of an organization, business, or community group, you have authority to bind that entity; and (d) your use of the Platform complies with all applicable local, state, national, and international laws and regulations.
We reserve the right to refuse registration, suspend access, or terminate accounts where we reasonably believe a user does not meet eligibility requirements or has provided false or misleading registration information.
3. Account Registration
Certain features of the Platform, including submitting listings, managing an account dashboard, uploading images, and accessing organizer or vendor tools, require account registration. When registering, you agree to provide accurate, current, and complete information and to maintain and promptly update your account information.
You may register as a general user, vendor, organizer, or other account type made available on the Platform. Account type selection may affect available features, profile fields, and applicable supplemental terms, including our Vendor & Organizer Terms.
Registration requires your affirmative acceptance of these Terms and our Privacy Policy. You may not create an account using false identity information, another person's identity without authorization, or an email address you do not control.
4. Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You agree to notify us immediately at info@hometownevents.org if you suspect unauthorized access, credential compromise, or other security incidents affecting your account.
Hometown Events is not liable for losses arising from unauthorized use of your account where you failed to safeguard credentials or failed to notify us promptly. We may require password resets, additional verification, or account suspension when we detect suspicious activity.
5. User Responsibilities
All users are responsible for their conduct on the Platform and for ensuring that their use complies with these Terms, our Acceptable Use Policy, Community Guidelines, and applicable law.
- Use the Platform only for lawful purposes and in a manner consistent with its community discovery purpose.
- Provide truthful information in profiles, listings, and communications.
- Respect the rights, safety, and dignity of other users and event participants.
- Verify important event details independently before attending, vending, or relying on listing information.
- Report suspected fraud, unsafe listings, intellectual property violations, or policy violations to info@hometownevents.org.
6. Organizer Responsibilities
Organizers who submit or manage listings assume additional responsibilities beyond general user obligations. Organizers are responsible for the accuracy, legality, and safety of events they promote through the Platform.
- Ensuring listings reflect current dates, times, locations, pricing, admission requirements, and contact information.
- Obtaining required permits, licenses, insurance, and approvals for events as required by applicable law.
- Communicating cancellations, postponements, venue changes, and material updates promptly to attendees and vendors.
- Complying with local health, safety, accessibility, tax, and consumer protection requirements.
- Handling attendee and vendor inquiries related to events they organize, except where Hometown Events explicitly assumes such responsibility in writing.
Organizer-specific obligations are further described in our Vendor & Organizer Terms, which are incorporated into these Terms by reference.
7. Vendor Responsibilities
Vendors using the Platform to discover opportunities, create profiles, or participate in community events must comply with all applicable vendor, business, food handling, tax, and licensing laws. Vendors are solely responsible for their products, services, representations, pricing, and conduct at events.
- Maintaining accurate business profile information, including contact details and applicable categories.
- Honoring commitments made to organizers and event participants unless prevented by lawful cancellation.
- Ensuring products and services comply with safety standards and local regulations.
- Respecting organizer rules, venue policies, and community standards.
- Not misrepresenting affiliation with Hometown Events or implying platform endorsement beyond permitted use of listing features.
8. Event Listing Requirements
All listings submitted to the Platform must be truthful, lawful, relevant to local community happenings, and sufficiently detailed for users to understand the nature of the event or activity. Listings must include accurate location information, dates, and contact details where applicable.
- Listings must relate to real events, sales, markets, fundraisers, or community activities intended for public or community participation.
- Duplicate, deceptive, expired, or placeholder listings are prohibited.
- Listings must not impersonate another person, business, or organization.
- Images and flyers must accurately represent the listed activity and must not infringe third-party rights.
- Pricing information, admission fees, and material conditions must be disclosed where known at the time of submission.
All listings are subject to review and approval before public display, unless otherwise stated. We may edit formatting, reject incomplete submissions, or request corrections before approval.
9. Prohibited Content
You may not submit, upload, or distribute Content that violates our Acceptable Use Policy, Community Guidelines, or applicable law. Prohibited content includes, without limitation:
- Illegal activity, stolen goods promotions, or instructions for unlawful conduct.
- Fraudulent, deceptive, or misleading listings or promotions.
- Hate speech, harassment, threats, or content targeting protected classes.
- Sexually explicit content unrelated to lawful community events, or content exploiting minors.
- Malware, phishing, spam, or attempts to harvest user data.
- Content infringing copyrights, trademarks, publicity rights, or other intellectual property.
- Dangerous activities promoted without appropriate warnings and lawful authorization.
- Content designed to circumvent Platform restrictions, scrape data, or abuse automated systems.
10. User-Generated Content
The Platform enables users to submit User-Generated Content, including listings, descriptions, images, logos, and profile information. You retain ownership of your User-Generated Content subject to the license granted to Hometown Events below.
You represent and warrant that you own or have obtained all rights, licenses, consents, and permissions necessary to submit your Content and to grant the rights described in these Terms, and that your Content does not violate any law or third-party rights.
Hometown Events does not pre-screen all User-Generated Content but reserves the right to review, moderate, reject, remove, or restrict Content at any time in accordance with these Terms and applicable law.
11. Content Ownership
Except for User-Generated Content, the Platform, including its design, software, code, branding, compilation of listings, and original materials created by Hometown Events, is owned by Hometown Events or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms transfers ownership of Hometown Events intellectual property to you. You may not copy, modify, distribute, sell, or create derivative works from Platform materials except as expressly permitted.
12. License Granted to Hometown Events
By submitting User-Generated Content to the Platform, you grant Hometown Events a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, display, distribute, adapt, format, promote, and otherwise use your Content in connection with operating, marketing, and improving the Platform and its services.
This license includes the right to use listing titles, descriptions, images, logos, and location information in search results, featured sections, SEO landing pages, email notifications, social media promotion, and future advertising placements related to the Platform. The license continues for a commercially reasonable period after Content removal for backup, audit, and legal compliance purposes, except where prohibited by law.
You may revoke this license with respect to future uses by removing eligible Content from the Platform, subject to our retention obligations and the rights of users who relied on previously published listings.
13. Listing Approval Rights
Hometown Events maintains sole discretion over listing approval, publication, categorization, featured placement, and visibility. Submission of a listing does not guarantee publication. We may approve, reject, queue, or request revisions to listings based on completeness, accuracy, community relevance, policy compliance, or operational capacity.
Approved listings may require re-review after edits, resubmissions, or reports of changed circumstances. Organizers and vendors acknowledge that approval indicates administrative review at the time of approval, not verification of all factual claims.
14. Listing Removal Rights
We may remove, suspend, or restrict any listing or Content at any time, with or without notice, if we believe it violates these Terms, applicable policies, law, or community standards, or if removal is necessary to protect users, the public, or the Platform.
Users may delete eligible pending or rejected listings through account tools where available. Approved listings may require re-review for changes rather than direct deletion, as described in account management features and our Vendor & Organizer Terms.
15. Platform Moderation Rights
Hometown Events may monitor, investigate, and take action regarding accounts, listings, and conduct reported or detected on the Platform. Moderation actions may include warnings, content removal, listing rejection, feature restrictions, account suspension, and permanent termination.
We are not obligated to monitor all Content but reserve the right to do so. Our moderation decisions are made in our reasonable discretion and do not create an obligation to police all user activity.
16. Suspension and Termination
We may suspend or terminate your account or access to the Platform at any time, with or without notice, for conduct that violates these Terms, creates risk or legal exposure, or is otherwise harmful to the Platform or its users.
You may stop using the Platform at any time and may request account deletion by contacting info@hometownevents.org. Termination does not relieve you of obligations incurred before termination, including indemnification, payment obligations for Paid Services, and liability for prior violations.
Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution—will survive.
17. Intellectual Property
Hometown Events respects intellectual property rights and expects users to do the same. Unauthorized use of copyrighted materials, trademarks, logos, or proprietary content is prohibited.
If you believe Content on the Platform infringes your intellectual property rights, please follow the procedures in our Copyright & Intellectual Property Policy and DMCA Policy.
18. Trademark Rights
"Hometown Events," "HometownEvents.org," related logos, and other brand identifiers are trademarks or service marks of Hometown Events or its affiliates. You may not use our trademarks in a manner likely to cause confusion, imply endorsement, or dilute our brand without prior written permission.
Users may accurately reference the Platform when describing where an event is listed, provided such use does not suggest sponsorship or partnership beyond ordinary descriptive use.
19. Advertising Policies
The Platform may display promotional content, sponsored placements, and featured listings. Advertising and promotional activities are governed by our Advertising & Featured Listing Policy, which is incorporated into these Terms by reference.
We reserve the right to reject, remove, or modify advertising or promotional content that is misleading, unlawful, incompatible with community standards, or inconsistent with Platform branding.
20. Featured Listing Policies
Featured listings receive enhanced visibility on the homepage, search results, or other designated areas. Featured status may be granted administratively or through future Paid Services. Featured placement does not guarantee attendance, sales, impressions, or business results.
Featured listings remain subject to content standards and may be removed if they violate Platform policies, even if payment was made, subject to our Refund & Cancellation Policy.
21. Future Paid Subscription Services
Hometown Events may introduce subscription plans, premium organizer tools, vendor profiles, promotional packages, or other Paid Services in the future. When launched, such services will be subject to additional terms, pricing disclosures, and billing policies presented at the time of purchase.
These Terms apply to all Paid Services unless expressly superseded by a separate written agreement or checkout terms. Continued use of Paid Services after updates constitutes acceptance of modified billing terms where permitted by law.
22. Payment Terms
When Paid Services become available, you agree to pay all applicable fees, taxes, and charges associated with your purchases. Payments may be processed through third-party payment processors. You authorize us and our processors to charge your selected payment method for agreed fees.
Failure to pay may result in suspension of Paid Services or related features. Refund eligibility is governed by our Refund & Cancellation Policy. Hometown Events is not responsible for bank fees, currency conversion charges, or processor errors outside our reasonable control.
23. Third-Party Links
The Platform may contain links to third-party websites, event pages, social media profiles, ticket sellers, or vendor sites. Such links are provided for convenience only. Hometown Events does not control and is not responsible for third-party content, policies, or practices.
Your interactions with third parties are solely between you and the third party. You should review applicable third-party terms and privacy policies before engaging with external services.
24. Third-Party Services
We may use Third-Party Services for hosting, email delivery, analytics, authentication, image processing, payment processing, and future advertising. Your use of the Platform may involve transmission of data to such providers as described in our Privacy Policy.
Hometown Events is not liable for interruptions, errors, or acts or omissions of Third-Party Services except to the extent required by applicable law.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMETOWN EVENTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, BUSINESS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE AMOUNT YOU PAID TO HOMETOWN EVENTS FOR PAID SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.
26. No Guarantee of Event Accuracy
Hometown Events is an online community discovery platform that allows users to browse, submit, promote, and manage listings for local events, sales, markets, fundraisers, and related community happenings. We do not create, host, or operate the underlying events listed by users except as expressly stated. Listing information is submitted by third parties and may contain errors, omissions, or outdated details despite review efforts.
Users are responsible for independently verifying dates, times, locations, admission requirements, accessibility, safety conditions, and all material event details before attending or participating.
27. No Guarantee of Attendance
We do not guarantee that any event will occur as listed, attract any number of attendees, or achieve any particular outcome. Attendance depends on many factors outside our control, including weather, competing events, organizer execution, and community interest.
28. No Guarantee of Vendor Sales
The Platform does not guarantee vendor sales, leads, booth bookings, customer traffic, or commercial success. Vendors participate at their own risk and are solely responsible for their business decisions, inventory, pricing, and compliance obligations.
29. Force Majeure
Hometown Events will not be liable for delay or failure to perform obligations resulting from events beyond our reasonable control, including natural disasters, severe weather, pandemics, government actions, labor disputes, internet or hosting failures, cyberattacks, or utility outages.
30. Indemnification
You agree to defend, indemnify, and hold harmless Hometown Events and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your Content; (c) your events, products, or services; (d) your violation of these Terms or applicable law; or (e) your infringement of third-party rights.
31. Dispute Resolution
Informal Resolution
Before initiating formal proceedings, you agree to contact us at info@hometownevents.org and attempt to resolve the dispute informally within thirty (30) days.
Binding Arbitration and Class Action Waiver
Except where prohibited by law or where either party seeks injunctive relief for intellectual property misuse, any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, unless otherwise agreed in writing.
YOU AND HOMETOWN EVENTS AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Exceptions
Either party may seek relief in small claims court for qualifying claims. Either party may also seek temporary injunctive relief in a court of competent jurisdiction to prevent unauthorized use of intellectual property or misuse of the Platform.
32. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent preempted by applicable federal law.
Where arbitration does not apply, exclusive jurisdiction for permitted court proceedings shall lie in state or federal courts located in New York, and you consent to personal jurisdiction in such courts.
33. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on the Platform and update the "Last updated" date. Continued use after changes become effective constitutes acceptance of the revised Terms, except where further consent is required by law.
